General terms and conditions of business


1. Scope

The following terms and conditions apply to all orders placed through our online shop. Our online shop is aimed exclusively at consumers.

2. Contracting parties, conclusion of contract, correction options

The purchase contract is concluded with SOLEA. By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods in the shopping cart by clicking on the order button. Immediately after submitting the order, you will receive another confirmation by email.

3. Contract language, contract text storage

We save the contract text and send you the order data and our general terms and conditions in text form. For security reasons, the contract text is no longer available over the Internet
accessible.

4. Prices and shipping costs

All prices are final prices and include VAT. Shipping costs are charged in addition to the prices stated. The amount of the shipping costs is shown to the customer before completing the order process.

5. Delivery conditions

In addition to the stated product prices, shipping costs may also apply. You can find out more about any shipping costs in the offers. Delivery will take place within 2-3 working days after receipt of payment, unless otherwise stated in the online shop. If the customer is not at home, a notification card will be left on which the customer can contact the delivery service to arrange a new delivery date.
We do not deliver to packing stations.

6. Payment

In our shop you can generally use the following payment methods:

Prepayment
If you choose to pay in advance, we will send you our bank details in a separate email and deliver the goods after receipt of payment.

Credit card
You provide your credit card details during the ordering process. Your card will be charged immediately after you place your order.

Apple Pay
In order to pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the "Safari" browser, be registered with Apple, have activated the Apple Pay function, authenticate yourself with your login data and confirm the payment instruction. The payment transaction will be carried out immediately after the order has been placed. You will receive further information during the ordering process.

SEPA direct debit

When you place your order, you give us a SEPA direct debit mandate. We will inform you of the date on which your account will be debited at least one banking day in advance (so-called prenotification). A banking day is every working day with the exception of Saturdays, federal public holidays and December 24th and 31st of each year. Your account will be debited after the goods have been dispatched.

Sofort by Klarna
In order to pay the invoice amount via the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have a bank account activated for online banking, identify yourself accordingly and confirm the payment order. Your account will be debited immediately after the order has been placed. You will receive further information during the ordering process.

EPS (only for customers with Austrian delivery address)
The eps transfer payment system is offered by PSA Payment Services Austria GmbH, Handelskai 92, Gate 2, 1200 Vienna, Austria. If you choose the eps transfer payment system, you will be redirected to a bank selection list. Here you can select your bank and will be connected directly to its online banking form. There you can enter your TAN or electronic signature and the purchase amount will be transferred from your account to our account.

7. Retention of title

The goods remain our property until full payment has been made.

8. Cancellation policy

The customer has the right to withdraw from the contract within fourteen days without giving any reason. The withdrawal period shall be fourteen days from the day on which the customer or a third party other than the carrier designated by him takes possession of the goods. The customer may use the attached sample withdrawal form for this purpose, although this is not mandatory. To meet the withdrawal period, it is sufficient that the notification of the exercise of the right of withdrawal is sent before the withdrawal period has expired.

Consequences of revocation:

If the customer cancels this contract, we will refund all payments that we have received from him, including delivery costs (with the exception of additional costs resulting from the fact that the customer has chosen a different type of delivery than the cheapest standard delivery offered by us), promptly and at the latest within fourteen days from the day on which we received notification of the cancellation of this contract. For this refund, we will use the same means of payment that the customer used for the original transaction, unless something else was expressly agreed with the customer; under no circumstances will the customer be charged any fees for this refund. We may refuse to refund until we have received the goods back or until the customer has provided evidence that he has returned the goods, whichever is earlier. The customer must return or hand over the goods to us promptly and in any event no later than fourteen days from the date on which he notified us of the cancellation of this contract. The deadline is met if the customer sends the goods before the expiry of the fourteen-day period. The customer bears the direct cost of returning the goods. The customer only has to pay for any loss of value of the goods if this loss of value is due to handling of the goods which is not necessary to check their quality, properties and functioning.

9. Warranty

The warranty is in accordance with the statutory provisions.

10. Liability

We are always liable without limitation for claims based on damage caused by us, our legal representatives or vicarious agents in the event of injury to life, body or health, in the event of intentional or grossly negligent breach of duty, in the event of a guarantee promise, if agreed, or insofar as the scope of application of the Product Liability Act is open. In the event of a breach of essential contractual obligations, the fulfilment of which makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner can regularly rely (cardinal obligations) due to slight negligence on our part, our legal representatives or vicarious agents, liability is limited to the amount of damage foreseeable at the time the contract was concluded, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.

11. Data protection

The data required to conclude the contract will be stored by us and treated in accordance with legal regulations. The data will not be passed on to third parties unless we are legally obliged to do so or the customer has expressly consented.

12. Applicable law and place of jurisdiction

Austrian law applies. For consumers, this choice of law only applies to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has his or her habitual residence. The place of jurisdiction for all disputes arising from this contract is our place of business if the customer is a merchant, a legal entity under public law or a special fund under public law.
